ISSUES RELATED TO AQUA ILLINOIS
OCTOBER 15, 2013 UPDATE

I.          INTRODUCTION: In our October 1, 2013 Aqua Update, we provided an overview of where we stand with regard to our concerns over Aqua’s past Sanitary Sewer Overflows (“SSO’s”), and our plans for addressing with both Aqua and permitting officials how to prevent more SSO’s in the future. Please refer to that our prior update for more background. As was the case with the first update, it is important to note that everything contained herein is still preliminary, and that additional documentation or information may dramatically change what is contained herein. It is for this reason that this document is intended simply as an update, and not as a definitive position.

II.         INVESTIGATION:

A.        Gathering of Documents: We finally were able to process all of the Freedom of Information Act (“FOIA”) responses and provide them to our engineering consultants, who are reviewing the documents now. The total number of individual .pdf pages was roughly 4,500, but with many of these .pdf pages having multiple original pages imprinted upon them via the FOIA response process, the total number of pages of documents to review was more than 5,000.

B.         Information Gathering: As previously noted, some of the information upon which our decisions will be made has not been memorialized in writing. We are gathering information from CWL staff, Aqua (which, as previously noted, has already provided a significant amount of information), governmental officials and staff, and others such as the engineers we have hired to help us evaluate our position with regard to Aqua.

C.         Reviewing Documents and Evaluating Information: The review of documents and the evaluation of information is likely to be completed by the end of the month. We expect that there will be preliminary discussions with our engineers before final conclusions and recommendations are issued by them. An early November 2013 reply to Aqua’s Response to our September 4, 2013 letter is expected.

III.       CONCLUSION: As previously noted, in order to make the best decisions for CWL, we are taking careful, calculated steps to ensure that we have a proper foundation upon which decisions will be made with regard to Aqua’s actions, both past and future. We ask the Members continue to be patient as we methodically handle this situation in the right way so that the actions we take have the highest likelihood of succeeding in ensuring that past actions are appropriately dealt with, and future problems are avoided to the best of our ability. Until we are at this point, we ask that the Members be as patient as possible to ensure that the actions CWL takes are in its best interests in both the short term and the long term.
