Saturday's Town Hall about By-Laws

  The turnout was small, which didn't surprise me. Probably 25 attended. The meeting started with Scott Pointner (your attorney) presenting an overview of the new By-Laws and the reasons both legal and common sense that they needed to be re-written. We must be in compliance with state law as well as other logical changes.
  It became obvious pretty quickly what was the major area of concern. I would guess 90% of the meeting revolved around the issue of rental restrictions. We need to discuss this issue.
  When you read the By-Laws please do so carefully. The rental restriction actually is a limit on the board's power to lower restrictions below 15% and also gives the board the power to set the limit higher than that as well as make provisions for special situations and how to handle a waiting list if it ever comes to that. Currently we are at about 12% rentals. If the board set the limit at 15% it would mean more than 50 more homes could still be rentals and that number could be revised upward if necessary. The only reason for this rule is to avoid Candlewick becoming known as a rental community rather than owner occupied. This is very much misunderstood.
  Once the By-Laws are passed the rules and regulations will cover how then restrictions will play out and as I said, those can be changed as necessary so this is not a problem.
  At this point the main thing is to get these passed so we can work on the fine points in the Rules & Regulations. We really do not want to spend your dues on further mailings as we had to do with the CC&Rs. Please help by mailing or dropping off your votes in and speaking to your neighbors as well. This is important.
